Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the game and related services ("Game" or "Service") provided by [Pusilung Studio] ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
Use of the Pusilung Service is also governed by Pusilung’s Privacy Policy. We may collect and use your content and information in accordance with this Privacy Policy.
By downloading Pusilung Games, accessing and/or using the Pusilung Service, you accept and agree to be bound by the Terms of Service, the Pusilung Privacy Policy.
Pusilung may amend, at our discretion, any portion of the Pusilung Policy at any time by posting or displaying the amended Pusilung Policy within and/or on Pusilung Games, Pusilung branded website. You will be deemed to have accepted such amendments by continuing to use the Pusilung Service. Except as otherwise stated, any such amendments will be automatically after they are initially posted.
2. License
2.1 Ownership of Pusilung
Pusilung owns, has licensed, or otherwise has the right to use all of the content that appears in the Pusilung Service, including, without limitation, a user account, virtual items and virtual currencies. YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN A GUEST (COLLECTIVELY, “GAME ACCOUNTS”), AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO A GAME ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF Pusilung.
2.2 Limited License
Pusilung hereby grants you a non-exclusive, non-transferable, and revocable limited license to use the Pusilung Service subject to the terms of the Pusilung Policy. You understand that virtual items and virtual currencies are provided solely for your entertainment use, and that you have a limited license to use them under the Pusilung Policy, not the ownership interest in them. Any “virtual currency” balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license.
2.3 Trades of Virtual Items and Virtual Currency
Pusilung prohibits and does not recognize any purported transfers of virtual items or virtual currency effectuated outside of the Pusilung Service, or the purported sale, gift or trade in the “real world” of anything that appears or originates in the Pusilung Service, unless expressly authorized by Pusilung. Any such transfer or attempted transfer is prohibited and void, and may subject your account to termination.
3. Game Account
If you use the Pusilung Service, we will create and assign to your device an identifier that is similar to an account number. We will use the Account information for providing customer support to any users.
4. User Content
4.1 Your Representations and Warranties
“User Content” means any communications, images, sounds, and all the material, data, and information that you or other users upload, submit, or transmit through the Pusilung Service. By transmitting, submitting, or posting any User Content while using the Pusilung Service, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential; (b) not in violation of any applicable laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; and (c) free of viruses, adware, spyware, worms or other malicious code. You acknowledge and agree that you are solely responsible for all User Content you post or otherwise transmit via the Pusilung Service. Pusilung assumes no responsibility for illegal contents or the conduct of any user submitting any User Content or for the failure of monitoring any User Contents that may be inappropriate under the Pusilung Policy. You further acknowledge and agree that any of your personal information within such content will at all times be processed by Pusilung in accordance with its Privacy Policy.
4.2 License to Use User Content
You hereby grant Pusilung a worldwide, royalty free, non-exclusive, and unlimited license to use any User Content that you upload, submit, or transmit through the Pusilung Service, including, without limitation, the right to sublicense and assign to third parties, and right to copy, reproduce, fix, adapt, modify, improve, translate, reformat, create derivative works from, manufacture, introduce into circulation, commercialize, publish, distribute, sell, license, sublicense, transfer, rent, lease, transmit, publicly display, and publicly perform. To the extent permitted by applicable laws, you hereby waive any moral rights you may have in any User Content.
4.3 Content Screening
You acknowledge and agree that Pusilung may reject, refuse to post, delete, or edit any User Content for any reason at its sole discretion.
5. Fees and Purchase Terms
You agree to pay all fees and applicable taxes incurred by you. Pusilung may revise the pricing for the goods and services it licenses to you through the Pusilung Service at any time. YOU AGREE AND ACKNOWLEDGE THAT Pusilung IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN A GAME ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.
Some of Pusilung Games may be described as a “free game” within the description page of App marketplaces. YOU MAY DOWNLOAD AND PLAY SUCH GAMES FREE OF CHARGE, BUT THEY MAY CHARGE REAL MONEY FOR ADDITIONAL GAME CONTENT.
In cases where a user has received compensation (such as codes, items, or other in-game benefits) following error resolution or purchase, and subsequently requests a refund, Pusilung reserves the right to suspend or permanently ban the user’s account without prior notice. This policy is to prevent abuse of the refund system and protect the fairness of the game.
6. Your Responsibility in Using Service
- Send, post, transmit or make available any material or information that may be abusive, threatening obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive;
- Stalk, harass, threaten, or defraud other Pusilung users or any members of Pusilung support personnel;
- Use, develop, or distribute any robot, spider, unauthorized script, unauthorized scraper or offline reader, or any other cheat, mod, hack or the like, or any unauthorized third-party software designed to modify or interfere with or provide automated access to or use of the Pusilung Service;
- Interfere with or disable any security-related features of the Pusilung Service, or any part thereof;
- Damage, disable, overburden, or impair the Pusilung Service, including, without limitation, by distributing harmful code or attempting to disrupt servers;
- Make improper use of Pusilung’s support services, including by submitting false abuse reports;
- Misrepresent the source, identity, or content of information sent via the service;
- Create a false identity or impersonate another person or entity;
- Reverse engineer or otherwise attempt to derive code or underlying ideas;
- Modify any part of the Pusilung Service without prior written consent;
- Infringe intellectual property or personal rights;
- Buy, sell, trade, or advertise to sell any virtual currency or items or Game Account for commercial purposes;
- Send unsolicited or unauthorized commercial or promotional content;
- Attempt to collect or disclose personal information; access another user’s account without permission;
- Assist or encourage any of the above; or use the service in violation of laws or this policy.
7. Third Party Advertising
Pusilung may feature advertisements from third parties or provide links on the Pusilung Service to third party websites or vendors. Any charges or obligations you incur in your dealings with these third parties are your sole responsibility. Pusilung makes no representation or warranty regarding any third-party content, goods and/or services and is not responsible for their practices or privacy policies.
8. SMS Notifications, Push Notifications & Local Notifications
We may send local or push notifications to your mobile device to make you aware of game updates, promotional events, new game information and other relevant messages. You can manage push notifications within the relevant game or your device settings. SMS will not be sent unless we obtain affirmative express consent as required by law.
9. User Interactions
9.1 Member Disputes
You are solely responsible for your interactions with other users of the Pusilung Service. We may, at our sole discretion, attempt to mediate disputes between users, but are not obliged to become involved.
9.2 Release
If you have a dispute with any users of the Pusilung Service, you release us (and our officers, directors, agents, subsidiaries, and employees) from claims, demands and damages arising out of or in any way connected with such disputes.
10. Suspension & Termination of Pusilung Service
- Service Changes. Pusilung may limit, suspend, or terminate your use of the Service and/or a game at any time, permanently or temporarily. No refunds or compensation are required in connection with discontinued elements.
- Game Adjustments. Pusilung may modify, adjust, or remove in-game content, features, or balance without prior notice and without obligation to compensate. Users may provide feedback.
- Inactive Accounts. If an account remains inactive for 180 consecutive days, Pusilung may permanently delete the account and all associated data without prior notice. Deleted accounts cannot be restored.
11. Disclaimers & Indemnifications
11.1 Disclaimer of Warranties
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE Pusilung SERVICE IS AT YOUR SOLE RISK AND IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND… Neither Pusilung nor its partners warrant that the Service will be uninterrupted or error-free.
11.2 Disclaimers of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Pusilung Parties are not liable for indirect, incidental, special, exemplary or consequential damages, and in no event more than the amount you have paid to Pusilung in the 180 days immediately preceding the claim.
11.3 Indemnification
You agree to indemnify and hold harmless Pusilung Parties from claims, losses, damages, liabilities, including legal fees, arising out of (a) your use or misuse of the Service, (b) your violations of Pusilung Policy, or (c) your breach of representations and warranties. Pusilung may assume defense with notice to you; you agree to cooperate.
12. General Provision
12.1 Entire Agreement
The Pusilung Policy is the complete and exclusive understanding relating to your use of the Service and supersedes all prior understandings.
12.2 Language
Translations are for information only and do not modify the English version. The English version controls in case of conflict. Failure to enforce any provision is not a waiver.
12.2 Force Majeure
Pusilung will not be liable for any delay or failure to perform resulting from causes beyond its reasonable control (e.g., acts of God, war, terrorism, network failures, cyber crimes, strikes, shortages, etc.). If any portion is determined invalid, the remainder remains in full force and effect.
The Terms of Service may be updated from time to time without prior notice. Changes take effect immediately upon being posted or implemented.
Management Policy
1. Basic Management Policy
- Purpose is to protect user rights and maintain order in using services jointly developed by the Company.
- The Company may revise the Management Policy within legal bounds and will notify Users at least 7 days prior (30 days for adverse changes).
- Interpretation follows the Terms of Service and applicable laws and practices.
2. Definitions
- The Staff: Company parties or those authorized to aid users.
- User: A person who signed a use contract to use Services.
- Name: Nicknames, character names, etc.
- Account Information: ID/password or information given by the Company.
- Game Information: Items, money, scores, achievements, etc.
- Inappropriate Behavior: Embezzlement, Cash Trade, Misusing Bugs, Unauthorized Programs, Assumed Names, Fraud, Abusing, Repeated Content, Disturbing Gameplay, Violation of Privacy, and other unsound behaviors.
- Embezzlement: Using others’ accounts/purchase info without consent, damaging game info, etc.
- Cash Trade: Exchanging Game Information for cash/objects.
- Misusing System Errors & Bugs: Deliberate exploitation of vulnerabilities.
- Unauthorized Programs: Programs/devices that interfere with Service or infringe rights.
- Assumed Names: Lying about identity.
- Fraud: Giving false information to cause damage.
- Abusing: Obtaining large amounts of game info via unintended methods.
- Repeated Content: Repetitive posting to complain or get attention.
- Disturbing Gameplay: Interfering or intruding Services to harm others.
- Violation of Privacy: Exposing or abusing personal information.
- Restriction: Limits on game/community use.
- Invalid Purchase: Purchases not recognized by the Company, incl. using third-party cards/phones.
- Invalid Sign Up: Malicious sign-ups to unfairly acquire items/money.
3. Customer Responsibilities and Rights
- Users must observe Terms and Management Policy; violations may incur liability.
- Users can utilize game elements and services provided.
- Company reserves all rights to game-related information and grants usage rights to users.
- Users may appeal unfair treatment and request policy application via legitimate procedures.
- Inquiries: [email protected]. Responses typically within 48 hours (may vary).
- Users must provide accurate registration info and keep it updated; misuse of others’ info is excluded from protection.
- Users must manage provided info and be aware of company notices; damages from neglect are not the Company’s responsibility.
- No commercial use without prior consent. No copying/redistribution without consent.
- Report vulnerabilities (bugs, failures, unauthorized programs) to the Company; do not exploit or propagate.
- Respect others’ rights; report suspected infringements.
4. Account Management
- Company protects Account Information; primary responsibility lies with the user.
- Users are responsible for consequences of third-party use due to negligence.
- Embezzlement of personal info may be criminally punishable.
- Sharing/trading accounts/characters/items may result in restrictions without prior notice.
5. Naming Policy
Names are free in principle, but Staff may change names that are offensive, abusive, infringing, impersonating, unlawful, or otherwise unsuitable for service health.
6. Recovery Policy
- Recovery is possible when losses due to company-related technical errors can be objectively verified.
- Treatment/investigation available when reported within 7 days (may vary by game DB retention).
- Only the affected user may file a recovery request; false requests may incur restrictions.
- No recovery for: non-owner accounts; damages from sharing/transfer/sale; late requests; fraud-related losses (perpetrators may be restricted and gains withdrawn); design/operational changes; event/compensation items; device changes/resets; app deletion on mobile, etc.
7. Roles and Responsibilities of Staff
- Staff comply with Terms, Management Policy, and Privacy Policy.
- Staff eradicate policy-contrary acts and strive for seamless Services.
- Staff do not request/modify/disclose personal info, except via legal authority requests.
- Staff receive and address bug/error reports promptly.
- Staff do not provide unofficial gameplay guidance.
- Staff do not intervene in normal user disputes, but may restrict Services for abnormal symptoms or policy violations, including warnings/forced disconnection/restrictions where needed.
8. Criteria for Inappropriate and Abnormal Behavior
Includes theft, cash trades, bug misuse, unauthorized programs, assumed names, fraud, abusing, repeated content, disturbing gameplay, privacy violations, unsound behaviors, and acts violating related laws. Examples include profanity, vulgar behavior, IP infringement, fraud related to Staff/developer/NPC, political defamation/advocacy, intent to trade cash/accounts, deliberate harm, illegal acts, defamation of religion/race/nation/group, and nuisance to others.

- Restriction period refers to the period you cannot use a game; does not include other games serviced through Pusilung.
- Pusilung account can also be restricted if laws are violated or if there is significant impact on games.
- Company can apply aggravated restrictions for multiple categories, withdraw illicit gains, pursue legal action, and accept appeals via designated procedures.
10. Community Management Policy
- Communities exist for information exchange and conversation; Company aims for a healthy and stable community.
- Company generally does not intervene in user disputes but may according to severity; posts that violate social norms may be deleted or restricted without prior warning; posts may be moved to appropriate boards.
- Inappropriate behavior in communities (as defined) may result in restrictions.
